Boy Breaks Both Legs After Being Trapped In L Train's Doors: Suit
The nine-year-old's family is suing the MTA.

BROOKLYN, NEW YORK -- A Brooklyn mom is suing the MTA after her son was trapped by the closing doors of an L train that began pulling out of the station and broke both his legs, court records show.
Melissa Capers filed a suit in Brooklyn Supreme Court Wednesday that details how her son was pulled between the gap of a Manhattan-bound L train and a platform in the Atlantic Avenue subway station on Dec. 10, 2017.
"Without warning or taking any steps to ensure the train was free and clear of any passengers approaching or at the door, the train began to move," the complaint reads.

"J.C. was caused to fall into the gap between the train and the platform and ... he was caused to be twisted and dragged down the platform for several feet."
Capers' attorneys will argue the MTA and New York City Transit Authority were negligent both in allowing the train to leave the station without checking the doors and for not addressing the "dangerous and horizontal and vertical gap" between the train and the platform.

"The MTA and NYCTA were negligent in allowing the train to move forward in such a manner," said Capers' attorney Edward Steinberg. "J.C. was stuck at the door and then caused to be dragged down the platform until such time as they realized and stopped the train."
The boy suffered two bilateral fractures to his femurs, underwent multiple surgeries and was forced to rely upon a wheelchair, according to the suit.
Capers is asking that $20,000,000 be paid in damages to her son and she receive $2,000,000 for damages and medical expenses, court records show.
The MTA declined to comment on the lawsuit.
