Police said Pagan was going to give her daughter a bath but left the 10-month-old alone and unsupervised July 8.

During what police said was “an unreasonable amount of time” when she was not in the bathroom, the tub continues to fill with water.

The father came home and found the child in the tub and tried giving her CPR.

She was pronounced dead at St. Luke’s Hospital in Newburgh.

Pagan was charged with criminally negligent homicide, a felony.

News 12 said Pagan on Tuesday waived a preliminary hearing and is still in jail.
