Refresher on NYS Paid Family Leave with a Q & A

NEW YORK PAID FAMILY LEAVE

Paid Family Leave (PFL) legislation begins in New York on January 1, 2018 as NYS joins California, New Jersey, and Rhode Island. Employees will be paid by a state fund and the maximum contribution will be set by the Superintendent of Financial Services. All employers in the private sector operating in New York State, regardless of the number of employees, must enact the Paid Family Leave benefit. Unless self-insured, employers must have DBL and PFL on the same policy.

WHO WILL BE COVERED?

Full-time employees at their current jobs for more than six

months or part-time employees who have worked 175 days.

WHAT DOES THE COVERAGE PROVIDE?

The ability to take paid-time off from work to care for a new

child or sick family members.

WHY SHOULD IT MATTER TO ME?

PFL coverage is required for all groups as compared to

Federal FMLA, which has a 50 employee minimum.

HOW WILL COVERAGE BE FUNDED?

Employee payroll deductions may begin 7/1/2017 while

employer participation is optional.
