Town BZA Hearing for Proposed Arby's Set for Wednesday
After building plan changes and community outreach, franchise owner will bring his variance requests before the board.
After three adjournments, meetings with surrounding neighbors and site plan revisions, an Arby's franchise owner will finally go before the Hempstead Town Board of Zoning and Appeals Wednesday at noon.
William F. Bonesso, Esq. is representing the applicant, Thomas J. Clarke. He is proposing a fast food restaurant, with drive-thru, on Sunrise Highway (at the old Speedy Muffler location.)
Clarke, is seeking variances for:

- front yard average setback
- construct building for proposed Arby's restaurant
- Special exception to install drive-thru window in conjunction with proposed restaurant
- Variance in off-street parking, waive design standards for on-site maneuvering (five parking spaces not at 90-degree angle) and special exception to park in front yard setback
- construct trash enclosure
- Install one double-faced, illuminated, detached ground sign, setback 10' from front property line and 15' 9" from side property line
- Install one menu board sign (not permitted) in conjunction with proposed drive-thru window
Members of the Bellmore Preservation Group, of which Clarke and his staff worked closely with regarding this proposal, are also expected to attend the hearing. They requested earlier closing evening hours and later morning delivery hours - all of which Clarke agreed to. A variance request for special exception to use part of premises for outdoor dining was also withdrawn.
The Board of Appeals is located at Town Hall, 1 Washington St. in Hempstead.
