Child Passenger Whe Driver Of Car Stopped On Shoulder Of I-684 Is Arrested For Felony Aggravated DWI: NYSP

The Port Chester man was arrested following a welfare check on the occupants of the stopped vehicle, according to troopers.

NORTH SALEM, NY — A Westchester County man has been charged with a felony Leandra's Law DWI.

On Sunday, at 3:40 a.m., New York State Police in Somers made a welfare check on a vehicle parked on the shoulder of Interstate 684 in the Town of North Salem.

The driver, identified as Hector Villa, 49, of Port Chester, showed signs of intoxication, according to troopers. Standardized Field Sobriety Tests were administered. A 14-year-old child was a passenger in the vehicle at the time, police said.

Villa was taken into custody and taken to State Police Somers for processing, where he submitted to a chemical breath test that yielded a blood alcohol content (BAC) of 0.09 percent, according to NYSP.

The child was safely released to a sober third party.

Villa was charged with felony aggravated driving while intoxicated with a child passenger (Leandra’s Law), driving while intoxicated with a blood alcohol content of 0.08 percent or more and driving while intoxicated.

He was issued traffic tickets returnable to the Town of North Salem Court on Oct. 26.
