Mt Kisco Man With Child In Car Caught In Labor Day DWI Crackdown

State police from Troop K announced they took 31 impaired drivers off Hudson Valley roads over the Labor Day holiday weekend.

MOUNT KISCO, NY — State police in Troop K arrested 31 drivers during the Labor Day weekend crackdown and charged them with driving while impaired. One of them, a Mount Kisco man, faces a felony charge.

On Sept. 2, State Police from SP Cortlandt arrested Jose N. Rubio, 32, of Mount Kisco, NY, for Aggravated Leandra’s Law DWI.

He was traveling on State Route 202 in Somers when he was stopped for a vehicle and traffic law violation. Investigation revealed that he was impaired by alcohol with a child in the vehicle, police allege.

Under Leandra's Law, driving while intoxicated and with a child in the car is a felony. Fines can go up to $5,000 and sentences can include prison time. It is named after an 11-year-old killed on the Henry Hudson Parkway in 2009.
