Online Fraud and intentional impersonations with intent to defraud or conduct crimes online-NYS needs to create a penalty base for violators

Who's ever been Ghosted online? Or who's been victimized by online predators impersonating someone or themselves with the intent of financial fraud? Raise your hand-or Post a comment. Facebook, Instagram, Twitter , dating applications, What's App are prone places for victimizations to spark. Profiles created, professional con artists looking to provide their Saga pleas of life's issues with a promise of love, a work assignment, or a new financial venture is tossed into the conversations. The best con artists are the ones who are White Collar Professionals; dazzling their charming ways-and once you seriously inquire on their vitals-you realize it's a Ghost-or some Group of want a bee's as I call it (CONS)-interested in only defrauding you. There's a lot of talk on how painful Ghosting situations impact a person because of the nature in which we connect as Humans-the need for socialization. We are now more than over dependent to online communications during Pandemic so we're not spreading or catching COVID 19.
Today, I reposting my Article in the Patch. The issue of Ghosting rules parallel with Online Romantic Scam Artists-but it's much more intergal because with a Ghost that person beforehand is an actual individual where personal relationship developed-live communications occurred-letters and thoughts exchanged creating relationship. In NYS-we still don't recognize the online development as a "Relationship"-it needs legal definition. That needs to happen Rule based immediately-and case law has not answered the need. Because NYS isn't recognizing the "Relationship" it becomes difficult to get the regulatory authorities and private sector entities (such as banks or creditors) to pursue the prep. Requirements need to be in place-so that once the Ghost develops into consideration-which always means in law-exchange of money or goods and services- then the victim can step forward, report it to proper law enforcement and with the Financial Sector communities domestic and abroad's assistance-meaning domestic financial institutions who have sister properties over seas MUST COMMUNICATE Such actions. Right Now-Victims are at the Mercy of the Ghost and Law Enforcement. This tiny "link" is missing to help victims pursue civil justice claims. It's up to law enforcement to pursue criminal crimes-if threshold in loss has been met.

With the enactment of NYS ANTi- Online Ghosting Rules the intent is to provide the Penal aspects of the example above; so that the financial institutions and or regulatory authorities who represent the Victims-can step up the investigations with the help of Financial Agencies to share information to apprehend. With this-then Ghosting becomes less POSH, Less Glamorous, Less of the impact-I can impersonate someone, get away with it and not be responsible for my actions-the issue is when Consideration exchanges (money equals love, goods and services provided equals a relationship). Now-due to State of Emergency and Pandemic COVID we are at the mercy of online lifestyle. Ghosting will become much more sophisticated with intent to defraud-it's not just about not sharing who the real identity is any more-it's become using false identities, ghosting after money or goods and services have been provided. This is the difference between Romantic online scams and Ghosting-because Ghosting previously did not recognize that consideration was exchanged. Complaints provided only recognized that "talk occurred and once one party leaves or deletes-they're just a Ghost" leaving the victim with no recourse.

Passage of Anti-Ghosting Law-grabs on to our rules of Online Romantic Scams by grabbing the little ghosters or trolls which might be sharing ones information for sale, to ring lead a group to keep it going-or worse create a Funding Source of unlimited treasurers for them. The Romantic Aspects might not be there yet in communications-so resources under Anti-Ghosting Law in NYS- can be one of the first to implement which is necessary. By passing the Anti Ghosting Law in NYS, it will have civil and penal aspects associated with it because once the Ghost has been secured in their Genie Bottle or Lantern (aka pattern)-the victims can proceed with Civil Law Suits. Creating Penal aspects of Ghosting opens the Statute of Limitations for the Victims and the Financial Institutions to pursue-instead of allowing these funds to be Ghosted Property-or lost.

This State of the Emergency in NYS-clearly defines the need for NYS to take Anti-Ghosting suggestive ways of not being defrauded to the Law Books. Because we're smart people in the 12th AD-if we're GHOSTED-and we learn this-then the ability to pursue the Scam artist must be in place. NYS needs to make this commitment to us-I will make this commitment today to the 12th AD-an Anti-Ghosting law will be enacted immediately-once I'm in Albany
NYS Penal Codes does recognize the severity of when a person intentionally impersonates another with severe civil and penal penalties; but once the situation develops online-it can become consuming to track down the offenders and bring them to justice.
NYS presently does not have a specific Anti-Ghosting ACT rule base; yet, but it's become necessary to implement penalties as our usage during COVID 19 Pandemic because online communications have become our primary usage of online communications. The ability for hackers or online sophisticated individuals to steal identities and utilized the materials they retrieve to impersonate someone with intent to defraud is even more sophisticated than years prior. Stealing intellectual property is on the rise-making it easier to enforce Anti-Ghosting measures, because technology cookies or love bites are left behind-which if discovered early into the process is punishable by law. However, when one creates an online profile, creating either a friendship or place for business relationship or romantic relationship to develop-and it becomes aggressive or demanding-as in asking for Money without providing the recipient with mutual consideration- it is necessary to introduce rules of law to bring con artists to justice to provide civil penalties for the victims who are impacted-and criminal sanctions so Law Enforcement has the tools behind them to track down the scam artists. By NYS taking proactive measures to protect victims of online Ghosting we in NYS are standing up and stating; "I will not allow these Ghoster's to get away with intentional actions to defraud-once money is exchanged mutually or by one party only-law recognizes consideration has been exchanged-a relationship has developed and if promises are exchanged to repay loans and Ghosting occurs-then legal resources or a way for the victim to pursue the scam artist with real results needs to be proactive and available- where I can enforce my rights", said Maryann Maltese.
This Legislative Bill Action in NYS will be the First Anti-Ghosting Law within in the Nation, said Maryann Maltese. It is necessary as professional scam artists have become more desperate in their plight to defraud-selecting honest and caring people to target- setting up locations in NYS to perhaps work with Out of the Country participants. Funding to support Local and International Law Enforcement-such as Legal Guidance needs to be funded-that's when you have justice, said Maryann Maltese. Women are mainly targeted by their social media accounts-and when the Con Artist develops a meaningful relationship with the victim-the GHOSTS-after Money (Consideration) exchanges-it can devastate a person to the core emotionally-but also placing them in financial harms way. These sophisticated Scam artists-they are more Brazen and often willing to continue contact with their victims-they get joy and a sense of satisfaction from victimization. Many are white collar professionals-or Models using the Ghosting Measures to continue scamming or stealing-but once NYS has this rule in place-it will send a message ringing through the Communications world not to tread here in NYS-I'm in favor of that. We've been educating our youth and family to see the signs, but at this stage-now that we're more aware-Enforcement for restitution is necessary. Maryann has worked on multiple laws to bring intentional criminals to justice-and this is where NYS needs to be the next leader.
This bill-the NYS Anti-Ghosting Law will give NYS Law Enforcement the tools and funding they need to perform these duties-Law Enforcement-they are ready to apprehend Ghosting Criminals. NYS Law Enforcement needs the funding to better serve the people of NYS and to assist Federal Authorities with higher pursuits for in-State Ghosting activities, said Maryann Maltese. Through this legislation-once NYS has the funds it needs-it will better enable Federal Law Enforcement Communications to apprehend out-of-state or international criminals.
I look forward to hearing the communities feedback on my suggestion on the Ghosting issue as a way to provide suggestions to add to the legislative intent of the Anti-Ghosting Law. It's not just confined to young people-it's now an issue for so many as we are further dependent to online communications with the entire world. Please keep track of your communications and if you suspect foul play-take a photo of suspected Ghosting communications or transactions and file NYS Police Reports and or IC3 complaints.
