For over 101 years; Women Earners in NYS-have not received Employment Equality in the Labor Force. Recent increases to NYS's Minimum Wage increase of $15.00 taking full impact by January 21, 2021-does not include Equality of Earnings requirements for prior Employment Contracts and new Employment Contracts to meet Equality Standards. California State has enacted State Earnings Quality-where is New York State on the Matter.

In 2009; NYS was the 49 State to ensure that Grounds of Hostile Divorces-or better know as "No-Fault" divorces be filed. NYS is not as progressive as one tends to believe-that Women who live outside of Large cities have same level of equality or access to it in various counties. Suffolk County for example has systematically voted against Women's Equality placing women in harms way. Without New York State taking the NECESSARY lead in ensuring that Federal Earnings Equality be legislated into STATE CODE-women are simply not equal and employers have and are taking full advantage of New York not making Earnings Equality for Women a State Law.

Here's the Answer; New York State Legislative Branches and Executive Branches of Government-the Largest Employer in the State-has violated Earnings Equality Laws. In 2014- Govenor Andrew Cuomo in his Executive Budget-passed in both Houses of the State Legislature -Acknowledged Women in State Government received discriminatory Employment Contracts which undervalued and underpaid Women for duties and service. However, Civil tort's have-not been issued to Women who have claims-especially tenured Women Staffers with their Back or Retroactive Earnings. It's now 2021-and because NYS as the Employer passed the Acknowledgement within the State Budget-it's law-but Employment Contracts going forward are still being issued on a"discriminatory basis" because the CIVIL relief to the Women impacted by NYS's discriminatory Employment Practices has not been "issued"! If those Torts-by additional Legislation requirements adding the required Earnings by State Actuary findings-Earnings Equality within the PRIVATE sector will not take effect. Case Law in the State of New York that has awarded Women in the private employment sectors-is not State Statutory Law-and as such-Employers are not bounded by Case Law decisions of Earnings Equality. Many of these cases have gag-orders associated with them-so the Legislature is unable to review them or use the Court Ordered Findings as a basis for Earnings Equality-keeping women at large at the mercy of the Courts.

This is unacceptable in the 101 Anniversary Years of declaring Women's Rights by granting Women the Right to Vote. NYS Legislature and their Executive Branches-must issue the tort aspects of their Acknowledgement as an Employer to NYS Public Officers-or Executive Staff who are entitled to back pay. Maryann Maltese is one of these Women-entitled to Correction State Legislation which provides the corrective actuary employment earnings added to her preexisting salary earnings that met injustice levels of discrimination in State Service. That's what NYS Legislature declared in 2014-6 months ago-I placed NYS as the Employer on Notice for my Retroactive-Back Earnings dues to being issued discriminatory Employment Contracts. I'm still waiting for the NYS Legislature to follow through on their "required issuance of back pay earnings". NYS as the Employer can not state-I will not review your Claim-because I'm tenured and our Public Service Code requires NYS to do so with care and due diligence and must furbish me with their results either way. NYS Legislature must adhere-to their own doctrines as an Employer that has violated Women with their issuances of Employment Contracts.

As NYS Legislature this week begins the 2021 Legislative Session-join me peacefully in advocating that the NYS Legislature follow through as the Employer on their Commitment to Women Earners. By Introducing and enacting the Maryann Maltese Corrective-Equality of Earnings Law; women at Large will have Earnings Equality in New York State. New Leadership positions were posted yesterday-where does our or your Legislator stand within Leadership roles?
