Maryann Maltese receive's Approval to Submit Election Appeal

Maryann Maltese, delegate candidate (Democratic Party) received approval by 2nd Judicial to review her Appellate Brief concerning Suffolk Supreme's decision to deny Maryann a hearing on her election law matter. On March 7, 2020-Governor Cuomo's Executive Order 202.2 pertaining to Election Law requirements mandating that Delegates or those that are not Political Party Endorsed or selected candidates "petition further" during social distancing mandates and police orders were in effect. The EO Language is in violation of not only Article 6-NYS's Election Law rules; but it's requirement enforcing statutory reasons of compliance while providing Party Candidates with extended time frames to hand in "required documentation or certification to be on the ballot" was not extended to Maryann Maltese; the delegate candidate for NYS Assembly 12th AD.

By the Governor enacting an Executive Order offering and granting extended time frames to Party candidates and not Delegates-he in it of itself declared; that My right to safe petitioning (which requires witnessing of a Voter's signature) is not as valuable or recognized by the law. Those actions are discriminatory and in violation of the Voting Rights Act's of 1964 and 1965; because all citizens through the right to vote must have equality in order to access the ballot. During Pandemic State of Emergency Orders did not treat me as an equal with pertaining to filing requirements to be eligible to run for the NYS Assembly Seat. The EO 202.2 Draws unfair differences in the rights of Party Candidates and Delegates-those of us registered in the same political party-but asking general citizens to support our placement on the ballot so that a Primary Election is scheduled. The worse Attach on America's Election Processes was the 9-11 Terrorist Attacks which was a direct terrorist hit to tread on us and "stop free election processes". In response to 9-11; NYS halted the Primary and provided both Political Party Candidates and Delegates-Primary Candidates with 2.5 weeks of time to ensure that all received equal protections under the law to run on the NYS Election Ballot.

I worked that day-Managing NYS Elections; fielding phone calls and being part of a team to create crisis management responses not only for the Election Processes; but for other Social Programs going forward, said Maltese. This EO 202.2 pertaining to Election Law is in violation of my Civil Rights to have the "same-access to the ballot and OPPORTUNITY to safely petition as a Delegate", said Maryann Maltese. By simply closing our eyes and saying-Oh Covid 19 is precedent and NOT supporting the Strict Interpretation of the US Constitution and NYS Constitution; we are caving into to FEAR and if we allow this-NYS Suffolk Supreme Court and/or the Language of EO 202.2 is no better than the Terrorist Attacks of 9-11-eliminating my democratic right to run for office. By doing so-we are stating in so many ways; that a Citizen does not have the same equal opportunity to safe petitioning endeavors while choosing to place themselves before their voting peers to say; I, Maryann Maltese, want to chance to represent you in NYS Assembly-and by you swearing you're a registered Voter of my Party (Democrat) you are granting me the chance to be listed on the ballot for you to review my candidacy going forward", said Maryann Maltese.

"I take Election Law and the ability for Citizens to have the chance to be on the ballot-seriously. I don't shrug it off as not having meaning or validity; when Leadership of any kind prevents a free election or prevents one from receiving the "same equal access to fairness"; because when that happens that Election Process is invalidate-this Election Process of 2020-is a violation of Article 6 and the Voting Rights Acts of 1964, 1965", said Maryann Maltese. In words of Congressman Lewis and his life work-I can not pretend that I have not also heard the call. Congressman Lewis continued the legacy and in my 30 years-I have done the same.

Additionally, I recently learned that ACT BLUE a not for profit which permits political fundraising organizations has presently taken the stance that only Party Chose Candidates can use their services-ACT BLUE to fundraise for their Campaigns. To me; this sounds like it's unethical and if not-then absolutely a bad business decision on the end of ACT Blue. A good question for ACT BLUE organizers-is why have they chosen to eliminate Delegates or Primary candidates from equal access of "having or using a business account with them". In my opinion, Act Blue's decision to deny me usage-is a bad business decision because wouldn't a quasi business organization want to permit user access and open accounts-it sounds like ACT Blue just lost customers or the potential their of", said Maryann Maltese. Maltese is a Certified Substitute Teacher with Brentwood UFSD, and after completing her NYS Public Service-attended BOCES Western Suffolk, Northport Campus and received her Cosmetology Licensure. Maryann is a UFT scholar with a Political Science BA from Queens College. Maryann was accepted into the NYS Trooper Academy while employed with NYS Legislature and remained in policy to foster her commitment in policy formations.

Maryann Maltese has 18 years of creditable NYS Public Service Experiences in both NYS Assembly and NYS Senate.
