Water Mill Man Drove Drunk With Niece, 5, In Vehicle: Police
He's facing a felony DWI charge under Leandra's Law, police say.
EAST HAMPTON, NY — A Water Mill man was arrested after he was found driving while intoxicated with his niece, 5, in the vehicle, police said.
Christian G. Marcatoma-Chaca, 26, was arrested on Sunday at 2:26 p.m. while driving a 2008 Honda south at the intersection of North Main Street and Collins Ave. in East Hampton after a call to dispatch reported a driver as "erratic" and "possibly drunk," East Hampton Town police said.
Upon interview, police said Marcatoma-Chaca had the strong odor of an alcoholic beverage on his breath and bloodshot and glassy eyes; he was also lacking proper coordination and was unsteady on his feet, police said. He performed poorly on all standardized field sobriety tests administered, police said.

He was arrested and charged with aggravated DWI with a passenger less than 16, first offense, a felony under Leandra's Law; acting in a manner injurious to a child less than 17, a misdemeanor; and DWI, first offense, a misdemeanor, police said.
The child was identified as his niece, police said.

He was released on his own recognizance, police said.
