Man Drove Drunk With Daughters In Car: Suffolk Police

The New Jersey man, who got charged with a DWI, had his daughters, ages 2 and 5, in the car with him on Friday afternoon, police say.

DIX HILLS, NY — A man was arrested Friday when Suffolk police accused him of driving while drunk when he had his two daughters in the car with him.

A man was driving a 2010 Hyundai Sonata recklessly in Dix Hills, a 911 caller reported, police said. The driver, Jack Miller, 31, of West Deptford, New Jersey, was stopped by police at the intersection of Deer Park Road and Alyssum Avenue around 3:30 p.m., police said. Miller failed a standardized field sobriety check and was arrested, police said.

Miller had his 2-year-old and 5-year-old daughters in the car, police said.

Miller was charged with two counts of aggravated driving while intoxicated with a child passenger 15 years old or younger (Leandra’s Law) and two counts of endangering the welfare of a child. The children were released to their grandmother.

Miller was held overnight at the Second Precinct and is scheduled to be arraigned at First District Court in Central Islip on Saturday.

Leandra's Law is a felony charge given to people who drive drunk while a child under 16 is in the car. The law was named in memory of 11-year-old Leandra Rosado who was killed when an SUV she and seven other children were riding in crashed on the Henry Hudson Parkway in Manhattan in October 2009, according to the state. Leandra was the only person to die in the crash. Her father championed the law.
