Westchester Trio Faces Drug Charges after Thruway Stop Near Albany

State police say they were carrying not only heroin but one of the substances used to treat opiate addiction.

New York State Police stopped a vehicle on I-87 for a speeding violation at 9:36 a.m. Saturday and ended up arresting three Westchester residents on drug charges.

The driver of the vehicle, James D. Tobin, 27, of Montrose, and his passengers, Thomas Johnston, 48, of Valhalla, NY, and Taniah D. Cousins, 21, of Mount Vernon, NY, were found to be in possession of heroin, Suboxone film strips, and marijuana. Suboxone, a Schedule III Controlled Substance, is used to treat opiate addiction.

All three were taken into custody, transported, and processed at the State Police barracks in Albany.

Tobin was subsequently charged with:

  • Criminal Possession of a Controlled Substance in the 5th; a Class D Felony
  • Criminal Possession of a Controlled Substance in the 7th Degree; a Class A Misdemeanor
  • Tampering With Physical Evidence; a Class E Felony
  • Controlled Substance Not in Original Container; Public Health Law Violation
  • Unlawful Possession of Marijuana; a Violation
  • Speeding Vehicle and Traffic Violation

He was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail in lieu of $50,000 cash bail or bond.

Johnston was subsequently charged with:

  • Criminal Possession of a Controlled Substance in the 5th; a Class D Felony
  • Criminal Possession of a Controlled Substance in the 7th Degree; a Class A Misdemeanor
  • Tampering With Physical Evidence; a Class E Felony
  • Controlled Substance Not in Original Container; Public Health Law Violation

He was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail without bail.

Cousins was subsequently charged with:

  • Criminal Possession of a Controlled Substance in the 5th; a Class D Felony
  • Criminal Possession of a Controlled Substance in the 7th Degree; a Class A Misdemeanor
  • Tampering With Physical Evidence; a Class E Felony
  • Controlled Substance Not in Original Container; Public Health Law Violation

She was arraigned before the Town of Bethlehem Court and remanded to the Albany County Jail in lieu of $10,000 cash bail or bond.
