Alleged MS-13 Members Charged With Murder For Subway Shooting: DA

Three alleged MS-13 gang members face murder charges for the fatal shooting in a Jackson Heights subway station.

JACKSON HEIGHTS, QUEENS — Three alleged MS-13 gang members stand accused of shooting a rival on a Jackson Heights subway station platform in an attack captured on viral video, prosecutors announced.

Ramiro Gutierrez, 26, Victor Lopez, 20, and Tito Martinez-Alvarenga, 19, were arraigned in Queens Criminal Court Tuesday on charges that they shot Abel Mosso on the 90th Street/Elmhurst Avenue 7-train platform in Jackson Heights on Feb. 3, prosecutors said.

The three Flushing residents face murder, gang assault, kidnapping and weapon charges, according to the Queens DA's office.

Michael Paul, the attorney defending Martinez-Alvarenga, said his client pleaded not guilty and that he plans to ask the judge to hold separate trials for the different charges, called a severance motion. Defense attorneys for Gutierrez and Lopez declined to comment on the indictment.

Video posted to social media, captured about 12:45 p.m., shows three men beating Mosso, 20, then dragging him onto the platform, where they repeatedly punched and kicked him. Gutierrez then pulled out a gun and shot Mosso six times in the face and head, according to the criminal complaint. Emergency responders pronounced Mosso dead at the scene, police said.

Gutierrez was arrested on Feb. 5 and Lopez and Alvarenga were arrested on Feb. 21, according to police.

The trio is slated to return to court on June 11 and could face up to 25 years to life in prison, prosecutors said.
