Legal Action Likely From Owner Of Mamaroneck Italian Ices Shop

Even the mayor said something should have been worked out.

MAMARONECK, NY — The Village of Mamaroneck could be facing a lawsuit over the closing of an Italian ices shop. Scott Rosenberg, owner of Ralph’s Italian Ices & Ice Cream, said he will likely sue the municipality after its Zoning Board of Appeals rescinded the shop’s certificate of occupancy.

Now the village’s mayor, Norman Rosenblum, has said an agreement of some sort should have been worked out, because the zoning board initially made a mistake in categorizing the location as a retail store, lohud.com said. [Get Patch’s Daily Newsletter and Real Time News Alerts here.]

Ralph’s had been plagued with complaints about noise and parking and wanted to apply for a special use permit, but the zoning board denied the application.
