Newburgh Man Arrested Twice In Same Day At Same House

Police said he called his victim in front of a judge, despite an order of protection.

WALLKILL, NY — A Newburgh man was arrested twice in the same day at the same home. Police said troopers responded to a domestic incident in the hamlet of Wallkill around 1:20 a.m. Friday. The investigation found that Jamill Smith, 22, of Newburgh, wouldn't leave the Wallkill residence during a verbal fight.

The altercation became physical when Smith forced the homeowner to the floor, holding the person down, police said.

While the victim was trying to call 911, Smith took the phone, preventing the victim from speaking to emergency services.

As Smith was leaving, he damaged the exterior door.

He was charged with criminal mischief and fourth-degree criminal mischief, misdemeanors, and second-degree harassment, a violation.

Smith was arraigned in the Town of Plattekill Court and released to return Dec. 6.

A full stay away order of protection was issued by the judge and served to Smith.

Later Friday, around 7:15 a.m., police said Smith returned to the home and the homeowner called 911.

Troopers said they saw Smith peering into the residence through a bedroom window.

He was arrested again and charged with second-degree criminal contempt, a misdemeanor.

During his second arraignment in the Town of Plattekill Court, Smith asked to use the phone and called the victim's cellphone in front of the judge.

He was sent to the Ulster County Jail in lieu of $1,000 bail or $2,500 bond, with a return date of Dec. 2.
