So … if you are stressed out about the Presidential election, get ready to be stressed out even more as the following three situations may play out over the next few weeks. Here are 3 ways the Presidential election may be decided that they are not telling you!

First, Pennsylvania. The battleground swing state is poised for an Election Law showdown before the U.S. Supreme Court. Nothing can be done about the executive decisions to sabotage the U.S. Postal Service’s ability to process or deliver mail, particularly mail-in ballots leading up to the election. What will happen is the mail-in ballot policies determined by the local officials in PA will end up before the Supreme Court after it is probably known which way the election may go, that is, either in favor of the incumbent President Donald Trump or challenger Vice President Joe Biden. The Supreme Court will either validate or invalidate votes, mainly from urban centers, that could tilt the state and our nation Left or Right.

Given the Supreme Court is a 6 to 3 conservative majority, we are more than likely to see the Supreme Court support Republican arguments in favor of incumbent President Donald Trump.

The next scenario is a “deadlocked” Electoral College. What happens if the Electoral College somehow becomes deadlocked? What happens if one of the members decide they are going to do what was done in 1801 and NOT vote? What if an Electoral College member decides to test the limits of their authority and votes for a candidate that is not reflective of the will of their state?

Yes – we know this would lead to more court action and likely go back to the Supreme Court; however, it may require the 12th Amendment to U.S. Constitution to step in.

Should the Electoral College fail, then the 12th Amendment holds that the United States House of Representatives votes for the President and the U.S. Senate votes for the Vice-President.

We know the House is led by Democrats and Senate by Republicans. Based on election results as of 7:40pm on Wednesday, November 4, 2020, it looks like the House is going to stay Blue for Democrats and the Senate is going to stay Red for Republicans. Nonetheless, if the House and Senate were to decide the Presidency, it would be very interesting and disheartening to have a “Biden-Pence” White House.

Stranger things have happened.

After all, 2020 started with the worst case scenario – the loss of Kobe, his daughter and friends, then the coronavirus pandemic hit and – quietly, very quietly – it was confirmed by the White House (of all places) that aliens are real. Forgive my digression… just be prepared for a rollercoaster series of events around complicated election laws.

Last, please try your best to not end life-long friendships over who is President.

With all seriousness, if you know anyone in a swing state or a place where ballots are being contested, encourage that person to follow up with their Board of Elections to ensure that their vote was counted. It would be terrible to learn that your effort and energy was wasted because a technicality took your vote away. It would be worse if your ballot just vanished like the 300,000 ballots we heard disappeared in Michigan. Whatever the case... let's all agree that every vote should be counted. It is the democratic way.
