NYC Man Convicted in Death of Mount Vernon Man

MOUNT VERNON, NY — Westchester County District Attorney Anthony A. Scarpino, Jr announced Monday that Bobby Jackson, 35, pleaded guilty before Judge Barry Warhit to:

  • one count of Murder in the Second Degree, a class “A” Felony,
  • one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Violent Felony,
  • one count of Reckless Endangerment in the First Degree, a class “D” Felony

in the shooting death of Charles Smith.

At about 5:23 p.m. April 17, 2016 Smith was riding his bicycle down East 3rd Street when he was spotted by Jackson, a New York City resident.

Jackson started jogging after him. Two blocks later, at East 3rd Street and South 1st Avenue, Jackson began shooting at Smith, and one of the shots hit him in the back.

The bullet entered the lower right side of the back, ripping through the victim’s kidney, colon, liver and a major artery to the lung. The victim then fell off his bicycle and smashed the left side of his head on the concrete pavement. He was dead within minutes, prosecutors said.

At the time Jackson was shooting, there were many pedestrians on the street in the line of fire, including a woman pushing a baby stroller.

Jackson stays in jail sentencing on May 16. He faces an indeterminate sentence, the maximum term must be life, and the minimum term may be not less than 15 years nor more than 25 years.

Assistant District Attorney Daniel Flecha of the Superior Court Trial Division is prosecuting the case.
