Peekskill Man Indicted For Murder In Duo Tapas Bar Slaying: DA

WESTCHESTER COUNTY, NY — A Peekskill man accused of firing shots into a Yonkers bar, wounding one worker and killing another, was indicted by a grand jury.

Yaquba McGougain was indicted on felony charges in connection with the Feb 6, shooting, Westchester County District Attorney Miriam Rocah announced today.

McGougain was indicted by a Westchester County grand jury for murder in the second degree, attempted murder, felony assault and criminal possession of a weapon. The 29-year-old was arraigned on March 21 and is being held without bail.

McGougain is charged with fatally shooting 22-year-old New Jersey resident Antonio Antoine-Fils at the bar on Yonkers Avenue in Yonkers. The victim, who worked at the tapas restaurant, was taken to St. Joseph’s Hospital, where he was pronounced dead. A second victim, who McGougain is also charged with shooting and injuring, was taken to Jacobi Hospital where he was treated for his injuries.

Investigators said the shooting happened at Duo Tapas Bar and Lounge just after 2 a.m. A dispute at the bar escalated to violence when police say McGougain fired several shots into the vestibule of the building, striking the two employees.

Investigators believe that the bar was hosting a party on the second floor that resulted in several fights between the attendees. Bar management stopped the party and was ushering the partygoers outside, some of whom were intoxicated and disorderly, according to police.

Investigators said that McGougain, a guest at the party, went to a parked vehicle and retrieved a handgun and then fired at least three gunshots into the vestibule of the building.

Both of the employees who were shot were helping the party crowd outside of the restaurant. The bouncer, a 23-year-old resident of the Bronx, was struck one time in the stomach and was treated and released.

Antoine-Filis was struck twice, once in the torso and once in the hand.
