Plea In Violent Rape Of Girlfriend With Kids In The Room

The incident in Spring Valley took place last fall, the DA said.

SPRING VALLEY, NY — A Brooklyn man raped, strangled and punched a woman with whom he had a relationship while their children were in the room. Holger Lema-Yaucan, 29, pleaded guilty to one count of Rape in the First Degree, a class “B” felony, Rockland County District Attorney Thomas P. Zugibe announced Wednesday.

The attack happened Sept. 9, 2017, at 18 Franka Place in Spring Valley.

“The defendant subjected the victim to a violent and terrifying sexual attack, during which he used excessive force and hit her several times in the face, just feet from their children," Zugibe said. "Today’s plea will spare the victim from having to testify against him at trial and the pain of having to relive her nightmare.”

Lema-Yaucan was arrested by members of the Spring Valley Police Department on Sept. 11, 2017.

He will be sentenced to eight years in state prison, followed by five years of post-release supervision, on Sept. 11, 2018. Additionally, he must register as a Sex Offender upon release.

The case was prosecuted by Senior Assistant District Attorney Kathleen Devlin and Supervising
Assistant District Attorney Jennifer Parietti.
