New Building Code and Zoning Violations Penalty Enforcement Rules

Get ready to pay more for building violations of code compliance, as Department of Buildings calls for increased penalties.

- New York, September 17, 2018 is the official deadline to submit a comment against or in favor of Department of Buildings newly proposed increase for penalties to a number of violations, and add some more violation types to their list.

The proposed rule will amend chapter 1 of Rules of City of New York, paragraph §102-01 by adding fifteen new infractions and updating penalties for several others. The new violations relate to:

  • Illegal residential conversions;
  • Monitoring occupied multiple dwellings with permits for alteration or addition;
  • Inspections of tenant protection plans
  • Pre-shift safety meetings for workers at construction sites;
  • Site-specific safety orientations for workers at construction sites
  • Construction site safety training

According to Building Violation Committee at Building Violation LLC, that monitors NYC rules, illegal residential conversions had already experienced a penalty increase in January of 2018. Back than violations for work without a permit, which typically create the illegal conversion, had risen to $6,000 for three or more family homes, and $600 for single and two family homes, respectively. With this new proposal the cost of resolving an illegal conversion, for example, are likely to go even higher than it was in January, and greatly higher than during previous years.
