Welcome Back ZBA Legal Notices

No, it's not the 1970's Sitcom "Welcome Back, Kotter," but the 2017 Clarkstown Sitcom, "Welcome Back, Another Missing ZBA Notice"

The Board of Appeals (ZBA) Legal Notices, missing since the beginning of June, 2017, have suddenly re-appeared on the Town of Clarkstown (Town) web page as of June 20, 2017.

While their reappearance in time for the next ZBA Public hearing scheduled for July 10, 2017 is welcome, it is also puzzling and ultimately incomprehensible.

That is to say, why were the ZBA Legal Notices for the scheduled ZBA Public Hearing on June 19, 2017 never posted on the Public Notices web page in the first place?

Why were ZBA Legal Notices only first restored on June 20, 2017, a day after the hearings for June 19, 2017 were completed?

Was there something in the appeals scheduled to be heard on June 19, 2017 that the Hoehmann administration was unwilling to share with the public?

Still missing, of course, since August 2016 are the ZBA Proposed Resolutions and the rationale for the decisions taken by the ZBA.

In their absence are what purports to be ZBA Minutes, with a brief and incomplete recitation of proceedings before the ZBA for each appeal heard and an alleged statement of how the Board members voted.

Of course, as previously discussed in this forum, absent a written proposed resolution before the members of the ZBA, any so-called “vote” is merely a consensus that has no legal effect whatsoever.

See, “The Restoration (Again) Of Minutes For The Clarkstown ZBA” posted on the New City Bulletin Board on June 7, 2017.

The sitcom “Welcome Back, Kotter” ran from September 9, 1975 to May 17, 1979.

Truth be told, I never liked it.

More to the point, however, is how long the Clarkstown sitcom will run.

Put simply, don’t the citizens of the Town deserve full transparency as to the workings of what is arguably the most important board (if not the second most important after the Town Board) in the Town?
