Candidate Maltese- Platform to Stream Line State Judicial Costs

Maryann Maltese, Democratic Candidate for NYS Assembly-12th AD, outlines some recommendations on improving services at State Supreme Court by requiring Clerk Offices to offer Notary Services for Parties of suits. Presently, the Clerks offices of State Supreme are not required to provide Notary Services for Plaintiffs or Defendants. Trying to locate a Notary at times-is time consuming when your case is scheduled on the docket. When-Notary Service is no where in site near many Court Houses and if the Court Law Library Service is not in session-or they Don't offer this service-as they are not State Mandated to presently do so-locating a Notary can be challenging. For example- take a look near Central Islip State Supreme Campus and let me know if and where you can find a Notary? Court users who do not have a car and rely on public transportation- are some of the hardest situations felt. Once at the court house-if a document needs to be notarized-locating a Notary can tie up a Court proceeding unnecessarily. COVID 19 Social Distancing and limited usage of the Court House-Clerk's Offices services-has shown light for the need for common sense ways to make the Clerk's Office much more user friendly for the general public, said Maryann Maltese.

Providing Notary service at the Clerk's window will ease tensions and demonstrate the Judical's commitment to moving cases forward. Filing Legal matters at times can be stressful moment in someone's life if you're not an Attorney. Filling forms is time consuming and when anyone needs a Court required form notarized and that service is not provided at the Clerk's window - it can set up a hostile environment-unnecessarily, said Maltese. This is why I support providing Notary Services at the primary steps of Court House-this will ease tensions and move cases forward on the Court docket and make the Court House more user friendly. I'm committed to making the Judicial process more user friendly and if necessary-once in Albany I'll introduce the bill which will require NYS Judicial Systems to provide Notary Services on site, said Maryann Maltese.

When Court Documents are not notarized-it can slow down the Docket Calendar causing unnecessary strife and additional legal fees which are costly, said Maryann Maltese. I'll introduce the State Legislation requiring that the Clerk's Offices associated with NYS State Supreme Court Systems provide Notary Service to Plaintiffs and Defendant's that provide proper state identification. Of course, those State Employees which pay to become Certified to be Notaries would be reimbursed for this business expense because they provided service of witnessing one's signatures on important documents which make the lives of New Yorkers better. If this needs to be legislated as well-I'll include the language in the Bill, said Maltese.

Another Legislative Bill Proposal would be to provide Free Court Fillings for NYS State Retirees who provide documentation of their successful retirement with NYS. Filing fees are costly-its $305.00 to receive an index number, $45.00 to file Motions and as NYS retirees seeking relief from NYS Judicial for private civil matter; like a name change, or a landlord-tenant issue; these court fees eat up a Retiree's Monthly pension-and therefore filing necessary court required forms to receive relief from the Judical-should be free. Most of us, who successfully complete State Service make 50% less in our Retirement years. As NYS Retirees; we gave Public Service and we don't receive Severances upon the successful completion of our State Service. Providing Retired NYS Employees with free court filings is a reasonable and justified-acknowledges our thanks to Public Employees their successful service and it once again reduces pressure on the Judicial Docket, said Maryann Maltese.

These common sense measures will make one's use of the Judicial more user friendly and supports my commitment to Working families-Governmental Families within the 12th AD-who simply can not afford to pay for legal representation and/or the fees associated with State Court Filings. NYS is in economic turn down-and it's necessary to point out where small changes to improve Judicial Services or improve the lives of Governmental Employees who might need to file or answer a complaint at State Supreme after retirement should be able to receive these services for free, said Maryann Maltese. Our Veterans receive so many Retirement services based on their service for free-healthcare is the biggest item Veterans receive (I'm in favor of this and more)-asking the State to provide State Employees with Free Court Legal Fee filings or to respond to required Court Actions-meets the mark, said Maryann Maltese.
