Indicted in Head-on Fatal Crash

A 23-year-old is accused of driving drunk.

A Yonkers man was indicted Wednesday on charges stemming from a fatal collision Aug. 11 on Palmer Road.

Acting Westchester County District Attorney James A. McCarty announced the charges against Liam Perry:

  • one count of Vehicular Manslaughter in the First Degree, a class “C” Felony,
  • one count of Vehicular Manslaughter in the Second Degree, a class “D” Felony,
  • one count of Aggravated Driving While Intoxicated Per Se, an unclassified Misdemeanor

The 23-year-old is accused in the death of Pedro Martinez, 85.

McCarty said at 9:20 p.m. Aug. 11, Martinez was driving in a 1995 Lincoln Town Car towards Bronxville on Palmer Road in Yonkers. At the same time, Perry was behind the wheel of a 2005 Toyota Camry traveling in the opposite direction.

When the vehicles reached the intersection of Palmer Road and Sunnybrook Road, Perry crossed the double yellow line and struck Martinez’s car head on.

Perry had to be extracted from his car by the Yonkers Fire Department. Both drivers were taken to Jacobi Medical Center in the Bronx. Martinez was later pronounced dead from injuries sustained in the crash.

Perry’s BAC was .27 percent, McCarty said.

Perry pleaded not guilty to the charges. He continues to be held at Westchester County Jail. Bail was previously set at $25,000 cash or bond.

The next court date is Jan. 18.
