The lawsuit claims the doctor was complaining about blurred vision.

PORT CHESTER, NY — A 70-year-old Port Chester woman is suing a surgeon because she said he was on his cell phone taking a Spanish proficiency test during her procedure. Mary Edwards is claiming emotional distress in her suit against Dr. Eric Fishman and Westmed Medical Group.
She was awake during the varicose vein surgery and said she heard Fishman complaining on the phone about having blurred vision, the Journal News said.
The lawsuit said Fishman told Edwards that was the only time he was able to take the proficiency exam.
