SELDEN, NY — Suffolk County Legis. Nicholas Caracappa's domestic violence-related charges will he handled by the office of Nassau County District Attorney Anne Donnelly as a special prosecutor at the request of District Attorney Ray Tierney, Newsday reported.

Tierney recused his office from overseeing the case to avoid any appearance of "impropriety," in a court filing, citing his "personal relationship with [Caracappa], including having appeared together while campaigning during the recent election," the outlet reported.

Caracappa was arrested at his home in December 2020, and was charged with first-degree criminal contempt and criminal obstruction of breathing, Suffolk police said.

His attorney, Thomas Campagna, told Newsday the charges are related to a dispute with Caracappa's estranged wife, who he said falsely accused him of choking her, saying the allegation is "100 percent untrue."

Caracappa hold the Legislature's fourth district seat which includes the Brookhaven Town portion of Ronkonkoma, as well as Centereach, Coram, Farmingville, Holbrook, Holtsville, Lake Grove, Lake Ronkonkoma, Medford, Port Jefferson Station and Selden.
