4X Repeat Felony DWI Offender Sentenced: DA

SOUTHAMPTON, NY — A four-time repeat felony DWI offender was sentenced Tuesday, Suffolk County District Attorney Ray Tierney said.

Pablo Aguilar-Alvarez, 36, a Salvadoran national, was sentenced to two and one-third to seven years in prison after a jury found him guilty of driving while intoxicated and other crimes, the DA said.

The conviction marked Aguilar-Alvarez's fourth DWI felony conviction within the past 10 years, in addition to a prior misdemeanor DWI conviction, Tierney said.

The evidence at trial established that on November 29, 2025, at about 1:24 a.m., Aguilar-Alvarez got behind the wheel of a car after an evening of drinking, Tierney said.

He drove with his girlfriend to the USA Gas Station at the intersection of Flanders Road and Longneck Boulevard in Flanders to purchase additional alcohol, the DA said.

While inside the store, Aguilar-Alvarez's girlfriend asked the clerk to call 911, the DA said.

Aguilar-Alvarez and his girlfriend then drove away from the location, the DA said.

After receiving the 911 call, which included a description of the vehicle and the license plate, members of the Southampton Town Police Department located Aguilar-Alvarez's vehicle, Tierney said.

Officers witnessed Aguilar-Alvarez fail to stop at a stop sign and cross over the double yellow center line on Longneck Boulevard before initiating a traffic stop, the DA said.

When the vehicle came to a stop, Aguilar-Alvarez exited from the passenger side in an attempt to conceal that he had been driving, Tierney said.

He failed standardized field sobriety tests and consented to a chemical breath test, which revealed a blood alcohol content of .17 percent, more than two times the legal limit, the DA said.

On August 7, Aguilar-Alvarez was convicted after a jury trial on one count of driving while intoxicated per se and one count of driving while intoxicated, both class D felonies, and one count of second-degree aggravated unlicensed operation of a motor vehicle, an unclassified misdemeanor, Tierney said.

Following the verdict, he was released by the court pending sentencing, despite the District Attorney's request for remand, and explicitly barred from driving, Tierney said.

On August 17, 2026, detective investigators from the Suffolk District Attorney's office initiated a traffic stop of Aguilar-Alvarez's vehicle in the vicinity of Main Street in Riverhead, Tierney said.

As alleged, he was found to be driving without a valid license and taken in for processing, the DA said.

After conferring with the District Attorney's office, federal immigration authorities detained Aguilar-Alvarez and later returned him to Suffolk County for sentencing, Tierney said.

On Tuesday, Aguilar-Alvarez was sentenced to two and one-third to seven years in prison, the DA said.

He was represented by the Legal Aid Society.

U.S. Immigration Customs Enforcement, or ICE, lodged a detainer to take custody of Aguilar-Alvarez following the sentencing, Tierney said.

Records indicate that Aguilar-Alvarez was deported from the United States on March 1, 2024, and is currently illegally present in the United States, the DA said.

"Pablo Aguilar-Alavarez was convicted for driving while intoxicated five times yet continued to get behind the wheel drunk, placing innocent lives at risk," said Tierney. "His repeated disregard for the rule of law and the safety of others makes clear that he is a danger to our community. Today's maximum sentence holds him accountable and removes a proven threat from our roads. Our federal partners will take custody of the defendant upon the completion of his sentence."
