AG Investigates After Off-Duty LI Officer Hits, Kills Pedestrian, 86
The off-duty Quogue Village Police officer, driving in his personal vehicle, hit the woman, 86, who died, the Attorney General says.
HAMPTON BAYS, NY — New York Attorney General Letitia James' Office has launched a special investigation into the death of a Hampton Bays woman, 86, who was struck and killed by an off-duty Quogue Village Police Officer in his person vehicle in January, the AG said.
According to Southampton Town Police at the time, the crash took place at 10:52 a.m.; Margaret Lucey was crossing Ponquogue Avenue westbound when a vehicle that was making a left from Good Ground Road onto Ponquogue Avenue struck her, police said.
The driver, Jon Stanton of Hampton Bays, remained at the scene and cooperated with the investigation; no charges were filed, police said. The AG, who did not identify Stanton, said that he was an off-duty Quogue Village Police officer.

Lucey was transported by Hampton Bays Volunteer Ambulance Corps to Stony Brook Southampton Hospital, where she succumbed to her injuries, police said.
Quogue Village Police did not immediately return a request for comment; attempts to locate Stanton's attorney were not immediately successful.

Pursuant to New York State Executive Law Section 70-b, OSI assesses every incident reported to where a police officer or a peace officer, including a corrections officer, may have caused the death of a person by an act or omission, the AG's office said. Under the law, the officer may be on-duty or off-duty, and the decedent may be armed or unarmed; also, the decedent may or may not be in custody or incarcerated, the AG said.
If OSI’s assessment indicates an officer may have caused the death, OSI proceeds to conduct a full investigation of the incident, the AG said.
