Appeals Court Says Westchester Obstructing Affordable Housing Plan

The county has lost seven appeals.

WHITE PLAINS, NY — A federal appeals panel said Westchester County is engaging in obstruction by not complying with the 2009 affordable housing settlement agreement requirements. The county has now lost seven appeals before the 2nd U.S. Court of Appeals.

The ruling said the county should stop making excuses and do what the consent decree requires, the Journal News said.

County Executive Robert Astorino has claimed Westchester is in full compliance with the settlement, FIOS1 News said.

But the Department of Housing and Urban Development rejected the county’s latest study of zoning and fair housing choices.

In December, Astorino said the county had exceeded the benchmark with 790 units — 40 more than required. He also said there were another 100 units in the pipeline.
