Chamberlain Excessive Force Suit Rejected By Federal Jury

His family said police entered the man's home against his wishes.

WHITE PLAINS, NY — A wrongful death lawsuit filed by the family of an African-American veteran who was shot and killed in his apartment by a White Plains cop was rejected by a federal jury Thursday.

News 12 said the jury didn’t find that excessive force was used by Police Officer Anthony Carelli because Kenneth Chamberlain Sr., 68, tried to attack him.

The judge in the case — Cathy Seibel — said there was no happy ending in this case for anyone, according to the Journal News.

Chamberlain was killed by police Nov. 19, 2011. His family first filed the lawsuit in 2012.

They said the housing authority and the police department violated the Marine Corps veteran's fourth amendment right by entering his home against his wishes.

His medical alert device had gone off accidentally, his family said, and police should have respected his request to leave after he said he didn’t need any assistance.
