White Plains: $21M Wrongful Death Suit Should Be Dismissed

The motions were filed Monday in U.S. District Court.

WHITE PLAINS, NY - The City of White Plains has asked a federal judge to dismiss a $21 million wrongful death lawsuit related to the shooting death of Kenneth Chamberlain Sr.

Lohud.com reported that the city’s lawyers and lawyers for police officers involved in the 2011 shooting of the retired correction officer filed the motions.

The family filed the lawsuit in 2012 citing the police department and the housing authority had violated Chamberlain’s fourth amendment right to be secure in his home by entering it against his wishes.

Chamberlain’s family said his medical alert device had been accidentally set off.

They said police should have left after the man told them he didn’t need any assistance.

The family said the police’s actions led to Chamberlain’s death because the police escalated the situation by calling the 68-year-old ex-Marine a racially charged epithet.
