Two Men Accused Of Raping Woman In Portable Bathroom Will Not Be Charged, Police Say

Two men were apprehended but later released because of lack of evidence and inconsistencies in the woman's story, police said.

WILLIAMSBURG, BROOKLYN — Two men accused of raping a woman in a portable toilet have not been charged because of a lack of evidence and inconsistencies in the woman's story, said police and witnesses.

The 26-year-old woman, who was found crying in front of 176 Banker Street around 6:20 p.m., said that two men had dragged her into a portable toilet and raped her, police and witnesses said.

Two suspects were apprehended hours later, but neither man was charged with a crime because of "inconsistencies" in the woman's story and a lack of evidence, police and law enforcement sources said.

But witnesses who saw the woman after the alleged attack said she appeared deeply upset.

Halcyon Gourmet Chef Maria Rizzo, 42, saw the young woman crying on the curb, she ran to comfort her and call the police, she said.

Rizzo held the 26-year-old who appeared "badly shaken" as they waited for police to arrive.

"She said they forced her into the port-a-potty and forced her to have sex with them," said Rizzo, "She was just crying and shaking, that was it.'"

Rizzo had just seen two men running down the street — one had flashed her "a big smile" — and when she asked the young woman if those were her attackers, the woman said yes, according to Rizzo.

Resident Diana Zelvin, 54, walked by after the woman had been helped into an ambulance — she saw a woman and a young boy crying as they watched the woman cry into her hands.

"It’s very scary," said Zelvin, who had walked down the street an hour before the woman was found. "I just wish I could have been there to help her."
