Plea Deals For Ex-Highway Supervisor, Cashier Accused Of Theft

Home Depot has been paid back the $14,469, prosecutors said.

WHITE PLAINS, NY — Yorktown resident Eric DiBartolo and Cortlandt Manor resident Tyrone Bass have been sentenced for stealing nearly $15,000 worth of merchandise from the Home Depot in 2020, Westchester County District Attorney Miriam E. Rocah announced Thursday.

DiBartolo, 60, pleaded guilty to Petit Larceny, and Bass, 59, pleaded guilty to Criminal Possession of Stolen Property in the Fifth Degree. Both are misdemeanors. Each was sentenced to a 1-year conditional discharge and 50 hours of community service, and both are barred from entering all Home Depot locations.

DiBartolo also paid full restitution for the items stolen from the Mohegan Lake Home Depot store, Rocah said.

“Eric DiBartolo hatched this organized and ongoing scheme to steal thousands of dollars of merchandise,” she said. “He and his accomplice will now be held accountable in a manner consistent with other perpetrators of similar theft operations.”

Bass and the former four-term Highway Superintendent and Yorktown Heights fire chief had both originally been charged with third-degree grand larceny, a felony that carries penalties ranging from probation to up to seven years in prison.

Prosecutors said that more than 20 times between August and December 2020, DiBartolo acted with Bass, a cashier at the store, to steal building supplies, tools and other merchandise from The Home Depot in Mohegan Lake, adding up to a total of $14,469.

During each visit, DiBartolo brought his merchandise to Bass, who only scanned a portion of the items and placed the remaining, unpaid merchandise into shopping bags. On each occasion, DiBartolo exited the store only paying for a few of the many items he left with.

Following an investigation, the Westchester County Department of Public Safety arrested Bass on December 16, 2020 and DiBartolo on Jan. 6, 2021.

The case was before Judge Maritza Fugaro-Norton in Cortlandt Town Court, and was prosecuted by Assistant District Attorney Livia Rodriguez.
