Shrub Oak Man Indicted In Peekskill Shooting Death
A third faces a charge of tampering with evidence.
PEEKSKILL, NY — Three men have been arraigned on a multicount indictment in connection with the July shooting death of a Bronx man in Peekskill. Demetrius Bogan of Peekskill, Sean Deleon of Shrub Oak, and Yaro Gaddy Waller of Peekskill were arraigned Thursday before Westchester County Court Judge Larry Schwartz.
Westchester County District Attorney Anthony A. Scarpino, Jr. said the indictment alleges that Bogan and Deleon shot and killed Khalil Lyons, 22, in the area of 1245 Park St., Peekskill, around 2:30 p.m. July 13, 2018. The third man, Yaro Gaddy Waller, has been charged with hindering the prosecution and tampering with evidence. (Sign up for Patch alerts to get police news straight to your inbox.)
Bogan is 19 and Deleon is 23.

Bogan and Deleon are charged with:
- Murder in the Second Degree, a class A felony
- Criminal Possession of a Weapon in the Second Degree, a class C felony
Deleon and Gaddy Waller, 19, are charged with:

- Hindering Prosecution in the First Degree, a class D felony
- Tampering with Physical Evidence, a class E felony
Deleon alone is charged with:
- Criminal Possession of Marijuana in the Fourth Degree, a misdemeanor
- Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor
Deleon and Gaddy Waller were arrested Aug. 7, and Bogan was arrested July 27, following a three-week investigation into the fatal shooting.
Bogan and Deleon have been remanded to County Jail. Gaddy Waller is free on bail. All three are scheduled to appear in court again Oct. 10.
Assistant District Attorneys Nadine Nagler, Chief of the Narcotics and Firearms Bureau, and Joseph Servino of the Superior Court Trial Division are prosecuting the case.
