Some Charges Dropped In July Ardmore Homicide Case

ARDMORE, PA — Some charges — including murder, robbery and conspiracy — have been withdrawn in the Ardmore homicide case from July, according to court documents.

Micah Colbert, 19, of Ardmore, and Elijah Smith, 21, of Philadelphia, were charged in connection with shooting death of Layth Evans, 19, of Philadelphia.

Layth was found with a gunshot wound to his face while sitting in the driver's seat of a vehicle at 122 Ardmore Ave. at about 3 p.m. on Saturday, July 10.

Court records show that authorities have withdrawn some charges in the case.

For Smith, he now only faces two firearm related charges after murder, robbery, and conspiracy charges were withdrawn on July 30.

Colbert still is being charged with murder, robbery, firearm crimes, and more. Court records show conspiracy to commit second- and third-degree murder, as well as conspiracy to commit robbery, have been withdrawn from Colbert's case.

Firearm charges filed against Dorian Harris, 21, of Ardmore, are still on the docket, according to court documents.

Smith was released July 30 from custody on $10,000 unsecured bail. His formal arraignment is scheduled for Sept. 22.

Colbert is still in custody after being denied bail.

Evans was pronounced dead at the scene by Narberth Ambulance personnel.

Detectives recovered $500 cash on the driver's side floorboard and a spent shell casing from the backseat floor of the car.

Eyewitness accounts, video surveillance, text messages and cellphone records indicate Colbert and Smith arranged a meeting with Evans in order to purchase a "ghost gun" — a firearm assembled from parts, making it untraceable — from Evans.

According to police, Colbert used Harris' firearm to shoot Evans in the face.

Around 6 p.m. on Saturday, Harris reported to the Lower Merion Police that his Glock 19 semi-automatic weapon had been taken and used by his roommate, Colbert. Harris turned over the weapon to police.

Video surveillance and eyewitness account confirmed Harris was not present at the shooting, police said.

A ghost gun was also located in the bedroom shared by Colbert and Harris.

Evans' cause of death was determined to be a gunshot wound to the face and the manner was determined to be homicide by the Montgomery County Coroner's Office.
