$20M Suit Filed After Boys Killed By Amtrak Train In Delco: Report

A new lawsuit accuses Amtrak of negligence and the wrongful deaths of two young Delaware County boys who died in April on railroad tracks.

CHESTER, PA — A major lawsuit seeking $20 million has been filed after two young boys were struck and killed by an Amtrak train in Delaware County earlier this year.

According to the Delaware County Daily Times, Siana Gordon and Wydeia Kimble are suing Amtrak for the deaths of their sons, Jahaad Atkinson, 9, and Ahyir Womack, 12.

The suit alleges Amtrak was negligent in not fixing a hole in a fence that the boys and other children used to get onto the tracks on April 29 in Chester.

Additionally, the suit says the boys were dragged by the train rather than dying instantly, leading Gordon and Kimble to file a survivor action, the outlet reports.

The incident occurred at about 4:35 p.m. Saturday, near the 400 block of Wilson Street, Chester Police said.

Officers were called to the area for a report of two juveniles being struck by a passing train.

The boys were hit by Amtrak Train 161, which was heading from New York to Washington, while they were with a larger group of children in the area.
