TikTok Lawsuit Over Delco Girl's Death Must Go On: Report

CHESTER, PA — A Delaware County family filed a lawsuit against TikTok in 2022 after her 10-year-old daughter died doing a challenge she saw on the social media app.
Nyla Anderson, of Chester, died at just 10 years old on Dec. 12, 2021.
She died after doing the "blackout challenge," which was popular on the platform at the time.

Anderson died in her bedroom while other family members were home.
Her family filed a suit against the platform, but the case was halted.

However, NBC10 reports a U.S. appeals court brought the suit back on Tuesday, allowing the family to continue is legal action against TikTok.
A spokesperson from TikTok told Patch back in December 2021 that the "challenge" predates the app.
"This disturbing 'challenge,' which people seem to learn about from sources other than TikTok, long predates our platform and has never been a TikTok trend," the spokesperson said in an email. "We remain vigilant in our commitment to user safety and would immediately remove related content if found. Our deepest sympathies go out to the family for their tragic loss."
