Starbucks is appealing the Newtown Twp Supervisors' decision to reject a drive-through location at the Village at Newtown shopping center.

Starbucks is appealing the Newtown Township Supervisors' decision to reject an application for a drive-through location at the Village at Newtown Shopping Center.

In May, the Board of Supervisors unanimously rejected a conditional use application for the coffee shop. Starbucks was seeking to open its third Newtown shop in the Village at Newtown West, adjacent to the relocated Bank of America.

On Tuesday, Starbucks filed an appeal in county court, saying the store satisfies standards in township zoning and the vote to deny it was “arbitrary, capricious, an abuse of discretion and contrary to law," according to The Intelligencer.

The coffee shop is proposed to be just about 1,900 square feet and have 41 seats. An additional 26 outdoor seats would be located in a contained area.

At the time of the vote, the Supervisors said the proposal would crowd the shopping center and squeeze too many buildings onto the shopping center site.
