Bill Cosby Appeal Will Not Be Heard By PA Supreme Court

The latest attempt by Bill Cosby's legal team to have charges thrown out has failed.

The latest attempt by Bill Cosby's legal team to have charges thrown out against him has failed.

The Pennsylvania Supreme Court will not hear his pretrial appeal, according to a decision issued by the court's Middle District.

Cosby's lawyers had hoped that because his accuser, Andrea Constand, was not in court to personally deliver her testimony during a May 24 preliminary hearing, charges could be thrown out.

Cosby will be tried for felony indecent assault and related charges connected to the 2005 allegations made by Temple University employee, Constand.

According to NBC 10, Cosby and his defense team want the opportunity to cross-examine Constand during that hearing.

The former comedian has already waived his appearance at his formal arraignment, which had been set for July 20.

A the May 24 hearing, police read Constand's testimony, which detailed her allegations of Cosby's abuse.

A formal trial date still has not been set, according to Montgomery County Court News, although a pretrial conference will take place on September 6.

Over 50 women have accused Cosby of indecent assault and related crimes, but Constand's case is the first to be brought this far along in the legal process.

Cosby continues to deny all allegations of abuse.
