Bill Cosby's Attorneys Again Seek To Have Charges Dismissed: Reports

Bill Cosby's attorneys say that because his accuser did not testify during the preliminary hearing, his case must be dismissed.

The lawyers for Bill Cosby are again attempting to have criminal charges against him dropped, this time because they say his accuser did not testify in person at the preliminary hearing, according to a correspondent with the Philadelphia Inquirer.

A Montgomery County judge had ruled during a May 24 preliminary hearing that Cosby would stand trial for criminal charges related to sexual assault.

During the hearing, his accuser, former Temple University student Andrea Constand, did not testify herself.

Officials read out Constand's statement on Tuesday, 6 ABC said, which goes into graphic detail of Cosby's alleged assault of her.

During the preliminary hearing, Cosby's defense team said that having Constand's statement read out was tantamount to hearsay, according to BBC.

Cosby has waived his appearance at his formal arraignment, which was set for July 20, according to the Associated Press.

Cosby is slated to be tried for felony indecent assault and related charges connected to the 2005 allegations made by Constand.

This is just the latest attempt and latest legal avenue Cosby and his defense team have pursued in their attempt to have the charges thrown out.
