DA Claims Cosby Motion Seeking Dismissal Of Charges Has 'No Merit'

Cosby's defense team alleges that the Montgomery County DA crossed an ethical line when he used Bill Cosby in his campaign last fall.

NORRISTOWN, PA -- Remember when Bill Cosby’s name was bandied about in the 2015 Montgomery County District Attorney’s campaign?

Bill Cosby’s lawyers do.

The embattled comedian’s defense team wants the newly elected DA, Kevin Steele, to be disqualified from all future proceedings against Cosby due to his “injection of allegations” into that campaign, according to the Pottstown Mercury.

Steele, however, was adamant that their motion was baseless.

“We are not surprised by the filing, which has no merit,” he said in a statement. “My office does not try any case in the court of public opinion. We try them in the court of law.”

Defense lawyers Brian J. McMonagle and Monique Pressley said Steele crossed an ethical line by using Cosby, calling him a sexual predator, to improve his political standing against his opponent, Bruce Castor, the report states.

Steele had alleged that Castor had missed an opportunity when he did not press charges against Cosby as Montgomery County DA in 2005.

The accusations became a key part of the campaign, as Castor argued that new evidence had come to light since he had left office, and that, at the time (last October) Steele and his team had still not prosecuted Cosby with the new evidence.

On Tuesday, Steele called the motion put forth by Cosby’s lawyers as “lengthy.”

“We will be filing a response to their motion, and we will let our legal response...speak for itself,” he said.

Cosby is accused of drugging and then sexually assaulting Andrea Constand, a Temple University employee, in 2005.
