The incident in question occurred at around 7:35 a.m. on Sept. 21, 2015 on the 500 block of Marion Avenue in East Norriton, the district attorney's office said.

The victim, Alfred C. Payne, 96, was walking in his driveway when authorities allege that Floyd attacked him, the DA said.

Floyd's attorneys argue that Payne simply fell and that Floyd rushed over to him to render aid, according to The Times Herald. When ambulances arrived, Floyd brought flowers over to Payne.

The DA said that Payne told first responders he had been assaulted and beaten. He suffered a broken hip in the fall, underwent surgery, and was sent to a longer-term care facility, where he died on Feb. 19, 2016.

Officials noted that Floyd and Payne had never met before the alleged attack.
