
We had an Agreement on a home. It was signed by the Sellers. We had the home inspection completed and we completed the Reply to Inspection within the time period allotted. Our Realtor did not forward the reply until 2 days past the contingency period and now the Listing Agent is claiming since it was late, we agreed to accept the property as-is. We do not! We would like to get our deposit back and our Realtor is not returning our calls at the moment. Can we contact the Listing Agent on our own?
This is a very difficult situation. If in fact your Realtor did not submit your Reply to Inspection in the time frame specified in the Agreement of Sale, according to the Agreement of Sale language, you were in fact accepting the property.
I would first start by contacting your Realtor's Broker. Explain the situation to him/her. They should be able to intervene and get to the bottom of this entire situation and perhaps offer some advice. It is difficult for me to offer any additional advise as I am not involved in the transaction.
Start with the Broker. It is unlikely he/she will ignore your calls. I hope all turns out well for you.
My house has been on the market for several months. I have done all that the Realtor asked me to do, with the exception of a few items. We have had showings but no offers. My Realtor now wants me to reduce. We have done this twice already. Why is the answer always reduce the price? Shouldn't more be done to sell the house?
I do not know what has been done to sell the house. Many times Realtors are consistently working on new advertising angles and changing advertising to help bring people to your listing.
You mention that you have done all that the Realtor has asked, with a few exceptions. Why have you not completed them? Perhaps your Realtor can see where the issues are and is trying to reverse the negative. It's extremely important that a house is clutter free, has a good crisp, clean line curb appeal and is clean from top to bottom.
Although I cannot offer you specific advice on the house, as I do not know which house it is, and you are represented, perhaps try to implement the ideas your Realtor has suggested. We can market the home extensively and add extras such as brochures out front of the house however we cannot force a buyer to purchase the property. Sometimes, as unfortunate as it sounds, the only choice is to reduce the price.
