Pennsylvania Law Change Restricts Some Fireworks Stand Sales

Last year was the first Fourth of July under Pennsylvania's new fireworks law that loosened previous restrictions on fireworks purchases across the state. Be aware that for the second Independence Day, some of those restrictions have returned.
The fireworks law passed in October 2017 permitted state residents to buy the full line of fireworks complying with federal requirements for consumers at any fireworks retailer. That included Roman candles, bottle rockets and various other aerial fireworks.
But the sale of those fireworks now is barred at temporary fireworks stands and confined to bricks-and-mortar dealers such as Phantom Fireworks and Sky King, which successfully sued the state to change the law. They argued that while their stores have sprinkler systems and other safety measures to contain any fire that might erupt, the temporary fireworks tents do not.

Anyone 18 or older can purchase fireworks in Pennsylvania, but if you buy them keep in mind the following restrictions:

- They can't be ignited or discharged on a public or private property without express permission of the property owner.
- They can't be discharged from or within a motor vehicle or building.
- They can't be discharged toward a motor vehicle or building.
- They can't be discharged within 150 feet of an occupied structure, whether or not a person is actually present.
- They cannot be discharged while the person is under the influence of alcohol, a controlled substance, or another drug.
Also, keep in mind that many local municipalities have banned the use of certain fireworks. It's best to check before buying.
