Cell Tower Case Closed
A company has dropped its court challenges to a zoning decision that blocked construction of a cell tower at the Dorneyville Shopping Center.

Liberty Towers LLC has dropped its court challenges to a Zoning Hearing Board that blocked construction of a 160-foot cell tower at the , South Whitehall Solicitor Joseph Zator said.
Liberty Towers, who wanted to build the cell tower for wireless provider MetroPCS Communications Inc., had challenged the zoning board's decision in both .
Zator said the company dropped the cases with prejudice, which means the cases cannot be refiled.

Zator defended the board's decision in federal court, while Zoning Hearing Board solicitor Maria Mullane defended the decision in state court.
Though the cases never made it into court, Zator said the township "proceeded to vigilantly defend" its position against the cell tower. He pointed to Mullane's "tenacious representation" as key to the outcome.

The zoning board had denied Liberty's requests last year for height and use variances to build the tower.
