NK Police Log: Birthday Designated Driver Arrested on DUI Charges

Information about the following incidents was supplied by the North Kingstown Police Department. An arrest does not indicate a conviction.

Susan Marie Gardner, 38, of 973 Smithfield Ave. in Lincoln was arrested Sept. 29 at 2:12 a.m. on charges of driving under the influence and cited for refusing a breath test.

Gardner was pulled over after an officer allegedly saw her driving the wrong way on Post Road, just south of the East Greenwich line. Once Gardner pulled over, her passenger exited the car and told the officer it was her birthday. While speaking with Gardner, the officer allegedly smelled alcohol on her breath. According to Gardner, the two women were leaving Kingstown Bowl, where she had two alcoholic beverages.

After reportedly failing her field sobriety test, Gardner took a preliminary breath test at the scene and registered a .123 percent.  Police also found two open cans of beer in her passenger’s purse, according to reports. Gardner was placed under arrest and taken to the North Kingstown Police Department, where she refused to take a breath test.

Deborah Jean Brown-Desio, 54, of 50 Payton Ave. in Warwick was arrested Sept. 30 at 12;30 a.m. on charges of driving with a suspended license.

Laurie Nagy, 54, of 5202 Mulhearn Drive in Coventry was arrested Sept. 29 at 9:45 a.m. on charges of violating a protective custody order. Gregg’s Restaurant employees contacted police after Nagy was allegedly acting erratically at the restaurant. While speaking with police, Nagy refused to cooperate with officers and attempted to fight one of them.

Rocco A. Tosoni, 26, of 302 Kenyon Ave. in East Greenwich was arrested Oct. 1 at 11:31 p.m. on charges of driving with a suspended license.
