Police Drop DUI Charge Against Former Jamestown Councilor David Swain
A charge of drunk driving against David Swain, who was once accused of murdering his wife, was dismissed on March 21.

A charge of driving under the influence (DUI) against former Jamestown Councilor David Swain, who was , was dismissed on March 21 in traffic court, reports The Providence Journal.Â
The charge was dismissed in exchange for a guilty plea to refusing a chemical test.
The former Jamestown councilor has now been ordered to perform 10 hours of community service, pay a $200 fine and pay various court costs, according to The Journal.Â

Swain, 56, of 993 Middle Road, was arrested in December on Middle Road, Portsmouth, after his vehicle reportedly nearly struck a police cruiser.Â
Police say a 1999 Toyota Corrola, operated by Swain, made a wide, right-hand turn onto Union Street from East Main Road. The Toyota nearly struck a police cruiser, which was stopped at the red light on Union Street waiting to turn onto East Main Road. He was arrested and charged with DUI at the time.Â

Swain returned to Rhode Island this past September after a Caribbean appeals court overturned a previous murder conviction, reported The Providence Journal.Â
