Intoxicated Man Allegedly Gets Too Close to Tiverton Officer's Gun

charged a man who, during a rescue response for an overdose, allegedly lunged at an officer and got too close to his firearm.
Charles McGuire, 37, of 29 Bridgeport Rd, Tiverton, was arrested at 2 a.m., Tuesday, June 5. He was charged with simple assault and resisting arrest.
Officers responded to the residence at 1:40 a.m. for a report of a possible overdose, according to Lt. Patrick Jones. Officers are met by family members who are concerned about McGuire, alleging he may have ingested too many pills.

"When they get there, they're trying to wake him up to see if he's okay," Jones said. "They call a rescue."
While reportedly attempting to stand him up, McGuire lunged at one of the officers, wrapping his hands around his waist. Jones said that after a brief struggle, the officer claimed that "several times" he could feel McGuire's hand on his firearm, causing him to turn rapidly to free loose.

Other officers were reportedly able to subdue McGuire, who was yelling and swearing. Given concern for him, Jones said McGuire was brought to the hospital. Once he was secured, McGuire was released from the hospital and charged.
Jones noted that in the officer's report, McGuire said he rarely consumes alcohol, but that he had taken Vicodin, drank a six pack of beer and alleged he takes Xanax.
