The driver of the tractor-trailer had pulled off the Interstate onto the right shoulder to check on a possible mechanical problem. The 2016 Isuzu NPR, driven by Montalvo-Lopez, was eastbound in the right lane of I-40 when the truck drifted onto the right shoulder and struck the rear of the trailer. Montalvo-Lopez was the only occupant of the landscaping truck wearing a seatbelt.
A blood sample from Montalvo-Lopez was analyzed at the MNPD crime laboratory and showed the presence of methamphetamine, oxycodone, ketamine, and ephedrine. A white crystal substance and a folded dollar bill which also contained a powdery substance was recovered from Montalvo-Lopez’ person.
