Jury Unable To Reach Verdict In First Twin Peaks Shootout Trial
Jurors said Friday they were hopelessly deadlocked in the trial of Jake Carrizal, a member of the Bandidos motorcycle club.

WACO, TX — The trial concerning Dallas Bandido member Jake Carrizal's involvement in a 2015 shootout in a Waco Twin Peaks restaurant ended Friday in a mistrial. After nearly 16 hours of jury deliberation, Judge Matt Johnson declared mistrial after the jury said they were deadlocked, WFAA reported.
Jake Carrizal, president of the Dallas Bandidos motorcycle club, was the first person to stand trial for involvement in the shootout. He was charged with engaging in organized criminal activity with an underlying offense of murder, engaging in organized criminal activity with an underlying offense of aggravated assault and directing the activities of a criminal street gang, WFAA reported.
The trial stems from the May 17, 2015 shootout at Twin Peaks restaurant in Waco, Texas, during which rival motorcycle gangs, the Banditos and the Cossacks, clashed. Carrizal told CNN the Cossacks, who weren't expected to be at the restaurant that day, "ambushed" the Bandidos during a regular meeting of the club. The Cossacks were gathered on the patio of the restaurant when Carrizal and other Bandidos pulled into the parking lot for the meeting, CNN reported. A firefight between the clubs broke out almost immediately. In the end, 9 people were killed and another 20 were wounded.

Jurors told Judge Johnson they were deadlocked Thursday afternoon and Friday morning, but he gave jurors an Allen Charge both times, The Waco-Tribune Herald reported. Cornell Law School defines an Allen Charge as "an instruction given by a court to a deadlocked jury to encourage it to continue deliberating until it reaches a verdict."
The Waco Tribune-Herald reported a jury foreman identified as "Mr. P" told his fellow jurors Thursday that he would not change his mind in deliberations, citing previous experience with the Cossacks, the other motorcycle club involved in the shootout.

In the end, the jury announced around 2:45 p.m.Friday that they were hopelessly deadlocked, the Tribune-Herald reported. Judge Johnson declared mistrial at that time. The declaration of a mistrial could result in an entirely new trial for Carrizal, but information regarding a possible retrial is not available at this time.
In total, 154 bikers were indicted on criminal charges of engaging in organized criminal conduct after the shootout.
