AG Named Special Prosecutor In David Temple Case

Temple, who spent nearly 10 years in prison for his wife's murder and was released in December, could get a new trial.

HOUSTON, TX — A man who was convicted nearly 10 years ago for the brutal murder of his pregnant wife in 1999, is expected to be granted a retrial.

David Temple, the former Alief High School coach who was sentenced to life in prison in 2007, went before a judge on Friday morning for a hearing.

Temple spent nearly 10 years in prison and was released in December after an appeals court judge ordered a retrial.

Harris County District Attorney Kim Ogg recused her office from the case after learning that an investigator working in her office had worked on the original case.

Evidence in the case, as many as 33 banker’s boxes, according to a KHOU report, has been transferred to the Texas Attorney General’s Office, who was named a special prosecutor in the case and who will determine if Temple will definitely be retried.

"The discovery materials are being transferred even as we speak from the district attorney's office here in Harris County, the Attorney General's Office. It was a massive project," said Trial Bureau Chief DA David Mitcham told KPRC.
